Consent regarding data transfer to countries outside of the EU

When you express interest in obtaining a guarantee of the African Energy Guarantee Facility (AEGF), it is necessary to transfer your personal data to the respective primary insurer, which carries out the application process and performs the data processing at its company location. The involvement of the primary insurer is necessary for obtaining insurance against political risks ("Political Risk Insurance"). A transfer is made, insofar as this is necessary to process your request, to the following primary insurer located in a country outside the European Union:

For Kenya, there is currently no adequacy decision by the European Commission within the meaning of Art. 45 (1) and (3) of the General Data Protection Regulation (GDPR). Therefore, a level of data protection equivalent to the European Union cannot be verified at present. Also, so-called appropriate safeguards pursuant to Art. 46 of the GDPR (binding corporate rules approved by a supervisory authority, standard contractual clauses, etc.) are currently not provided. As a result, particularly the following risks cannot be ruled out at this point:

• The data protection principles of the GDPR are not complied with or are complied with only to a limited extent (e.g. technical and organisational measures for the protection of personal data do not fully meet the requirements of the GDPR in terms of quantity and quality).
• You may not be able to sustainably assert or enforce your rights acc. to Art. 15 ff. GDPR against the primary insurer (e.g. your right of access)
• A data protection supervisory authority, which e.g. controls the primary insurer and handles complaints might not be established in the respective country
  We therefore only transfer your data to these third countries if you give us your explicit consent. By ticking this box, you consent to the transfer of your personal data to the respective Primary Insurer in Kenya for the purpose of providing the information or advice you have requested.
